Cookies are deleted in accordance with our cookie policy, which is available via our cookie banner.

However, the information may be stored for a longer period in anonymised form.

  • Managing your subscription
  • Statistics and analysis
  • Targeted marketing. Data collected via cookies (where you have given your cookie consent) is compared with your subscription account details to personalise and target our marketing to you, so we only send you marketing we think will be interesting for you. See also paragraph1 above.

 

Legal basis for processing

We process your personal data on the below-mentioned bases:

  • Contractual obligations: The basis for the processing of your personal data is our contract with you regarding your SunsetPLUS subscription (Article 6(1)(b) of the General Data Protection Regulation).
  • Legitimate interests: We process your personal data based on our legitimate interest in conducting statistics and analysis to improve the user experience and our legitimate interest in sending you targeted marketing (Article 6(1)(f) of the General Data Protection Regulation).
  • Marketing consent: Sunset Boulevard may use your personal data for direct marketing purposes, including to send you newsletters, if you have given your prior and explicit consent to this (s. 10(1) of the Danish Marketing Act (markedsføringsloven)).

Retention period

As a general rule, we will process your personal data for the duration of your subscription, but we may keep the data for a longer period if required by law, for example the Danish Bookkeeping Act (bogføringsloven), which requires us to keep information relating to accounting records for up to 6 years (Article 6(1)(c) of the General Data Protection Regulation), if the processing is necessary for the establishment, exercise, or defence of legal claims, or for our legitimate interest in managing your rights as a former customer (Article 6(1)(f) of the General Data Protection Regulation).

In addition, the data may also be anonymised and used for statistics and analysis.

You can always withdraw your marketing consent by clicking on the unsubscribe link at the bottom of each email or by contacting us as described below. However, withdrawing your consent does not affect the legality of the processing that preceded your withdrawal.

We will keep documentation of your marketing consent for two years from the date you withdrew your consent to receive direct marketing material. We have determined the retention period based on our legitimate interest in being able to demonstrate that we have sent direct marketing in compliance with applicable legislation (Article 6(1)(f) of the General Data Protection Regulation).

 

2.3. SunsetPOINT

Types of personal data

When you sign up as a SunsetPOINT member via our website or our app, we process your personal data. We may process the following types of personal data about you:

  • Name, e-mail, and telephone number
  • Log-in, including password
  • Order history and receipts
  • Favourite restaurants
  • Preferred purchases
  • Your points and discounts earned
  • Consent to marketing
  • Acceptance of terms and conditions
  • Information on your use of the service
  • Information from your SunsetPLUS subscription if you were previously a SunsetPLUS subscriber
 
 

The purposes of the process

Your personal data will be processed for the following purposes:

  • Managing your membership
  • Statistics and analysis
  • Targeted marketing. Data collected via cookies (where you have given your cookie consent) is compared with your membership account details to personalise and target our marketing to you, so we only send you marketing we think will be interesting for you. See also paragraph1 above.

 

Legal basis for processing

We process your personal data on the below-mentioned bases:

  • Contractual obligations: The basis for the processing of your personal data is our contract with you regarding your SunsetPOINT membership (Article 6(1)(b) of the General Data Protection Regulation).
  • Legitimate interests: We process your personal data based on our legitimate interest in conducting statistics and analysis to improve the user experience and our legitimate interest in sending you targeted marketing and suggesting purchases based on previous orders (Article 6(1)(f) of the General Data Protection Regulation).

 

  • Marketing consent: Sunset Boulevard may use your personal data for direct marketing purposes, including to send you newsletters, if you have given your prior and explicit consent to this (s. 10(1) of the Danish Marketing Act (markedsføringsloven)). It is a condition of becoming a SunsetPOINT member that you have consented to receive marketing. However, you can always withdraw your consent and continue your membership.

Retention period

As a general rule, we will process your personal data for the duration of your membership, but we may keep your personal data for a longer period if required by law, for example the Danish Bookkeeping Act (bogføringsloven), which requires us to keep information relating to accounting records for up to 6 years (Article 6(1)(c) of the General Data Protection Regulation), if the processing is necessary for the establishment, exercise, or defence of legal claims, or for our legitimate interest in managing your rights as a former customer (Article 6(1)(f) of the General Data Protection Regulation).

In addition, the personal data may also be anonymised and used for statistics and analysis.

2.4. Webshop

Types of personal data

When you use our webshop, we process your personal data. We may collect, process, and store the following types of your personal data:

  • Your name, email address, phone number, and address
  • Your payment details (if you use a credit/debit card, we only register 12 out of the 16-digit card number to identify your order in our system)
  • Information about your order/purchase history
  • Information you provide when completing a purchase or otherwise communicate with us
  • Use of discount codes and/or other membership benefits
  • Consent to marketing, including newsletters
  • Digital footprints (e.g., information about how you use Sunset Boulevard’s webshop)

The purposes of the process

Your personal data will be processed for the following purposes:

  • Completion of orders in our webshop, including sending of order confirmation and invoice
  • Managing deliveries and complaints
  • Managing your membership account and your use of our membership benefits
  • Sending out marketing
  • Statistics and analysis

Legal basis for processing

We process your personal data on the following bases:

  • Legitimate interests: We process your personal data based on our legitimate interest in marketing ourselves to you in cases where consent is not required as well as our legitimate interest in being able to conduct statistics and analysis with the purpose of developing and improving our services (Article 6(1)(f) of the General Data Protection Regulation).
  • Contractual obligations: We process your personal data to fulfil the purchase agreement concluded with you, including in order to deliver the ordered goods, handle order confirmations, complaints, returns, etc. (Article 6(1)(b) of the General Data Protection Regulation).

   

Retention period

Personal data registered in connection with purchases on Sunset Boulevard’s webshop is stored for up to 6 years. The retention period is determined on the basis of the retention requirement in s. 12 of the Danish Bookkeeping Act (bogføringsloven).

However, we can process and store your personal data for a longer period in anonymised form, or if we are obligated to do so by law.

 

2.5. Marketing, including newsletters, invitations to events and competitions, etc.

Types of personal data
Sunset Boulevard uses your personal data for direct marketing purposes, including sending out newsletters and invitations to events and competitions, if you have given your prior and explicit consent to this. If you have used our services, we may also send you invitations to customer satisfaction surveys and guest feedback (participation is voluntary).

We may collect, process, and store the following types of your personal data:

  • Name, e-mail address, telephone number and address
  • Your consent
  • Clicking behaviour on the website and in published material
  • Your response to our customer satisfaction survey
  • Order history, including any previous correspondence

  • Consent: We use your personal data for direct marketing, including sending newsletters and invitations to events and competitions, if you have given your prior and explicit consent hereto (s. 10(1) of the Danish Marketing Act (markedsføringsloven) and Article 6(1)(a) of the General Data Protection Regulation).

Your personal data will be stored as long as your consent to receive newsletters is active.

You can always withdraw your consent by clicking on the unsubscribe link at the bottom of each email or by contacting us as described below. However, withdrawing your consent does not affect the legality of the processing that preceded the withdrawal.

2.6. Contact form and other communication

When you use our contact form under “Praise and criticism” or communicate with us in another context, we process the following types of personal data about you:

  • Name, email address, phone number
  • What your enquiry concerns, e.g., order and payment details
  • Date of your enquiry
  • Other information you provide in connection with your enquiry. We encourage you not to provide us with sensitive personal data or your social security number unless it is strictly necessary for the processing of your enquiry. If you submit sensitive personal data or a social security number by e-mail, the data should be sent in a highly encrypted form.

Legal basis for processing

We process your personal data on the below-mentioned bases. The basis depends on the nature of your enquiry.

  • Legitimate interests: We may process your personal data based on our legitimate interests in handling your enquiry, communicating with you, and developing our products and services (Article 6(1)(f) of the General Data Protection Regulation).
  • Contractual obligations: If your enquiry concerns the (potential) conclusion of a contract, we will process your personal data to implement pre-contractual measures (Article 6(1)(b) of the General Data Protection Regulation).

General enquiries are stored for 12 months, but the retention period depends on the content of the enquiry.

Personal data relating to accounting records, which we are obliged to store under the Danish Bookkeeping Act (bogføringsloven), is kept for up to 6 years.

3. If you visit our restaurants

When you visit our restaurants, Sunset Boulevard processes your personal data, and you can read more about our processing of your personal data in this paragraph.

When you visit our restaurants, we process the following types of personal data about you:

  • Your purchases
  • Payment details (if you use a credit/debit card, we only register 12 out of the 16-digit card number to identify your order in our system).
  • Date and time of your visit
  • Photo and video material in connection with television surveillance in our restaurants
 

The purposes of the processing

Your personal data may be processed for the following purposes:

  • To complete your purchases
  • To monitor and maintain the security of our restaurants
  • To prevent and solve crimes
 

Legal basis for processing

We process your personal data on the following bases:

  • Legitimate interests: We base the processing of your personal data on our legitimate interests in ensuring the safety of our visitors and our staff (Article 6(1)(f) of the General Data Protection Regulation). Data relating to criminal offences collected through CCTV is also processed based on our legitimate interests in solving criminal offences (s. 8(3) of the Danish Data Protection Act (databeskyttelsesloven)).
  • Legal obligation: The processing of your payment details and information about your purchases is necessary for compliance with applicable bookkeeping, VAT, and marketing legislation (Article 6(1)(c) of the General Data Protection Regulation).
 

Retention period

Surveillance footage taken for crime prevention purposes will be deleted or anonymised within 30 days from the day of the recording, unless it is necessary for Sunset Boulevard to retain the recording for the purpose of handling a specific dispute, for example in connection with solving a criminal offence.

Information relating to accounting records which we are obliged to keep under the Danish Bookkeeping Act (bogføringsloven), is kept for up to 6 years.

However, we may process your personal data for a longer period in anonymised form.

Disclosure

In the event of criminal acts or suspicion thereof, recordings from television surveillance, etc., can be disclosed to the police. Sunset Boulevard’s surveillance cameras are registered in the Police Camera Register (POLCAM). Disclosure may also take place if required by law.

At the entrance to TV-monitored areas, we have placed signs locally in the restaurants in accordance with the Danish Act on TV Surveillance (tv-overvågningsloven).

4. If you are a contact person of a supplier, business partner, etc.

If you cooperate with Sunset Boulevard through your professional activities, including as the owner of a sole trader business or as a contact person of one of our suppliers or other business partners, you can read more about our processing of your personal data here.

  • Your work-related contact information, such as email address, phone number, and address
  • Contractual information, such as orders, invoices, contracts, and other agreements between your company (or your employer) and Sunset Boulevard, which may contain, for example, your contact information.

We may receive such information directly from you (primarily through emails and other correspondence with you) or from a third party such as your employer. We process your data if your company or the company you work for enters into an agreement with Sunset Boulevard, if you have shown interest in our products and services, for example by sharing your contact information with us, or in connection with other cooperations.

Personal data relating to professional collaborations are generally kept for up to 6 years after termination of the agreement or collaboration unless specific reasons justify a longer retention period.

Social media providers process your personal data for the following purposes:

  • To provide Sunset Boulevard with statistics which the social media providers compile based on, among other things, your visit to our profiles and pages

Legal basis for processing

The processing of your personal data is based on the following legal bases:

  • Legitimate interests: We base the processing of your personal data on our legitimate interests in communicating with you and market ourselves to you on our social media profiles, as well as our legitimate interest in improving our products and services (Article 6(1)(f) of the General Data Protection Regulation).

Social media providers base the processing of your personal data on their legitimate interests, including their interest in improving their ad system and providing statistics to Sunset Boulevard, which the social media provider, for example, complies based on your visit to Sunset Boulevard’s profile or social media page. In addition, the social media providers have a legitimate interest in providing an innovative, individually adapted, secure, and profitable service (Article 6(1)(f) of the General Data Protection Regulation).

  • Consent: The social media providers process some of your personal data in accordance with your consent, which you can withdraw at any time through your social media privacy settings (Article 6(1)(a) of the General Data Protection Regulation).

   

Retention period

We keep your enquiries, which are not publicly posted, for up to 2 years. However, the information can be stored for a longer period in anonymised form.

We encourage you to delete comments, likes, and other interactions you have left on our profile yourself if you no longer want them shown on our pages. Sunset Boulevard does not delete such publicly available interactions.

Who do social media providers share your personal data with?

Social media providers may, among other things, share your personal data with the following categories of recipients:

  • Other entities in the group of which the social media provider is a part of
  • External partners providing analysis and survey services
  • Advertisers
  • Other individuals visiting our social media profile or page (to the extent that your personal data is publicly available)
  • Researchers and other academics

The social media providers may transfer your personal data to recipients outside the EU/EEA in accordance with applicable data protection legislation. 6. If you apply for a job

If you are applying for a job at Sunset Boulevard, you can read more about our processing of your personal data in connection with the recruitment process in this paragraph.

We recommend that your application does not contain a social security number or sensitive personal data, such as personal data revealing racial or ethnic origin, religion, trade union membership, sexuality, or health information.

Types of personal data

Sunset Boulevard may collect, process, and store the following personal data:

  • Contact information such as name, email address, and phone number
  • Information contained in the application, CV, and any supporting documents
  • Relevant information publicly available on the internet and social media, including information on previous employment, activities, competences, performance, and general appearance
  • Results of personality tests if you complete any
  • Criminal records if required for the position you have applied for
  • References from your previous and/or current employers
  • Health information, if the position you have applied for requires special health conditions
  • Additional information you provide in relation to the recruitment process
 

Purposes of the processing

Your personal data is part of our evaluation of whether you will be offered a position at Sunset Boulevard.

Legal basis

Sunset Boulevard will process your personal data based on the following legal bases:

  • Legitimate interests: We process your personal data based on our legitimate interests in assessing whether we can offer you a job, including on the basis of publicly available information on the internet and social media. (Article 6(1)(f) of the General Data Protection Regulation).

 

  • Consent: If we obtain references from previous and/or current employers that you have not provided as references in your application, we will ask for your consent (Article 6(1)(a) of the General Data Protection Regulation). If, exceptionally, the position you have applied for requires specific health conditions, we will ask for your explicit consent prior to the processing of such personal data (Articles 6(1)(a) and 9(2)(a) of the General Data Protection Regulation).

 

Retention period

If you are offered a position with Sunset Boulevard, your application and additional relevant personal data obtained during the recruitment process will be stored in your employee file according to Article 6(1)(b) of the General Data Protection Regulation.

If you are not offered a position, we will store your application and any additional personal data obtained during the recruitment process for a period of 6 months following our rejection, unless you have provided your consent to the storage hereof for a longer period.

You may withdraw any consent you may have given as part of our recruitment process at any time. The withdrawal of your consent will affect the future processing of your personal data but will not affect the lawfulness of the processing based on the consent prior to the withdrawal. If you wish to withdraw your consent, please contact us as stated below.

If we have collected your criminal record, we will delete it immediately after our review.

7. If you use our whistleblower service

The purpose of our whistleblower service
Suspicions of improper conduct and violations of applicable law or internal guidelines can be reported through our whistleblower service.

When an alert is issued, we will process personal data of the data subjects who are part of the alert (i.e. the sender of the alert, the person who is the subject of the alert and other third parties involved) for the purpose of handling and investigating the alert.

If you report a presumed infringement, such alert will remain confidential and, at your option, anonymous. However, you should in any case provide an e-mail address at which you can be contacted, as we may need to obtain further information about the infringement in order to handle the case properly.

Legal basis

Sunset Boulevard processes your personal data on the following legal bases:

  • Legitimate interests: We may process your personal data on the basis of our legitimate interest in investigating reported infringements (Article 6(1)(f) of the General Data Protection Regulation).
  • Legal obligation: As it is a legal obligation for Sunset Boulevard to have a whistleblower system, we process personal data in order to fulfil our legal obligation to keep the system operational and to handle the alerts made through the system (Article 6(1)(c) of the General Data Protection Regulation).

Retention period

We store the personal data for as long as necessary to handle the specific alerts.

8. Disclosure to other data controllers and outsourcing to data processors

To fulfil the above purposes, we may give access to your personal data to third parties who provide us relevant services on the basis of a contractual relationship with Sunset Boulevard. This may include, for example, IT suppliers, mail and marketing providers and IT solution providers. Such service providers will only process personal data in accordance with our instructions according to concluded data processor agreements.

As described in the previous paragraphs, Sunset Boulevard may also disclose your personal data to business partners in areas such as social media, advertising, and analytics. The purpose of the disclosure is to target and personalise marketing to you via either our or third parties’ websites.

The chain of restaurants under the Sunset Boulevard concept is operated by Danske Koncept Restauranter A/S and partners (franchisees) who operate individual restaurants. To the extent that restaurants are operated by independent franchisees, personal data may be collected, transferred, or disclosed between these companies for the processing of the above-mentioned purposes. The disclosure is based on our legitimate interest in operating a unified concept and to offer you the same customer experience, benefits, and services regardless of how you are in contact with us (Article 6(1)(f) of the General Data Protection Regulation).

In the context of Sunset Boulevard’s development, the corporate structure may change, for example through the full or partial transfer of the activities of Sunset Boulevard. In the event of partial transfer of activities containing personal data, the legal basis for the related disclosure of personal data is generally our legitimate interests in developing and transferring activities (Article 6(1)(f) of the General Data Protection Regulation).

Your personal data may be transferred to data processors or data controllers established in countries outside the EU/EEA that do not have an adequate level of protection. Such transfers will only take place once a transfer tool is secured.
